I used to be a Detention Deputy, and we had two isolation cells like this. We just looked in the window at the floor to make sure the drain in the floor still had all it’s vent posts, just in case someone broke them off to use as a weapon (which has happened, not to me, but that’s why they started counting the drain posts) There was no need for this amount of force. Obviously you wouldn’t do that alone, that’s a huge safety risk, but with a few officers for back up, you could take care of this by just going in there, or you could just wait until they calm down, or wait for the nurse to come by to see if they snapped out of their episodes. Multiple options that would’ve been safer for everyone involved.
I can tell from the deputy’s body language that he’d been waiting to do that to someone for a long time. Absolute dishonorable, sociopathic, and criminal, behavior. The orange forend on the shotgun designates it as only to be used for less-lethal rounds and would have been a reminder to the officer using it, more evidence the deputy purposely shot and maimed the prisoner. They have rubber and bean bag rounds if they needed to actually hit the subject., the distraction round they shot him with could be just as dangerous as a real shotgun round if it hit an artery. This bum just wanted to hurt someone.
I think it’s past time for “officers” to be required to carry personal professional liability insurance. Nurses …NURSES those of us just trying to help people carry it. Imagine if their insurance company drops them for any misconduct and then they can’t ever work in law enforcement again for being too high risk!! Great way to weed out the bad ones quickly!
I’m a retired U.K. prison Officer and I can’t believe what I’ve just seen. It’s incomprehensible to me that these officers carry guns at all, but to see one used in a situation where it could NEVER be justified is beyond me. The guy was in his cell and he was no danger to anyone, so for this coward to put his gun through the flap and shoot him should result in an attempted murder charge.
As a foreigner who’s visited America as a tourist, I’m not going back until this shooting of people stops. We probably need to boycott American products in order to make corporate America put pressure on politicians to create real change to improve the lives of the American people and protect them. Because we see thousands of these articles of American cops killing and shooting American people and it doesn’t stop. The politicians seem to not be interested in protecting their own people. It looks like the politicians are only interested in what the corporations give to them. So it looks like we have to communicate with the corporations that they need to do something. Corporations, You are the ones with political connections, You are the ones who can make a difference.
NO Criminal charges?! This stuff is sick man I can’t believe what cops can get away with. “No policy in place for the use of this round”, then it has to be treated like a regular shotgun round fired at a human being, not ignored. If he grabbed the gun from the officer and fired it in his direction, he would be charged with attempted murder. There would be no discussion of the “type” of round in the gun. This officer needs to be fired and sued by the victim and his family.
I was in jail for a bit because of an absolutely ridiculous cop on a power trip… i can without a doubt say that Cops and CO’s are some of the lowest scum on this planet. I would trust gang banger thugs over law enforcement/ Correctional officers. Then the law wonders why people have a distrust of the justice system as a whole. Jails and prisons are just modified torture chambers with fat ass’s running them who hate thier jobs but love taking thier anger out on any of the inmates. I saw a situation where they strapped a man into the chair and repeatedly punched him while he was handcuffed for “mouthing off”. No one reported it… no one cared bc the man was mentally ill. He was in for a stupid probation violation as well. Our system is rotten and corrupt as all get out. Im sad to say that when i hear about an officer or CO getting killed at work or on the beat… i have 0 sympathy. They treated me like an animal in their when i showed them the upmost respect. They even laughed when i almost had a heart attack due to getting no beta blocker dispite me telling them my medical history, just casually joking to each other while i was on the floor in a puddle of my own vomit and piss. Saying things like “your gonna have to get a better acting coach”… that was the last one i heard before waking up in the ICU of our local hospital. I will never go out of my way to help a police officer or a CO, they are vile people who likely enjoy taking thier frustrations and home issues out on innocent civilians and inmates.
I worked in a psychiatric intensive care unit. We used to enter the padded cell with normal clothes on us, no shields or padding. Just 3 of us could take down any patient no matter their size or strength. We were trained in PMVA ( Prevention + Management of Violence + Aggression ) which teaches arm lock techniques, tactics and how to take a psychotic person to the ground without hurting them or any nurses. Our nurses have more balls than all those juiced up prison guards with all their weapons.
There are extraction teams, mostly the biggest goons in the department. Usually called the G00N SQUAD… Usually, There are no guns or firearms allowed in these facilities. Why a shotgun was used with or without a deadly round in an enclosed facility is beyond my understanding. What i do understand was the intent to harm maim and destroy a fellow human being. The intent was shown in the shooters eyes and manner of reloading the shotgun. It was for the thrill and self gratification…People of this sort tend to wind down and slipped a thorazine or melaril tablet in their food and kept under 24/7 watch with 15 minute walk throughs. As to the verdict,fault was found but this continues due to Qualified Immunity. Taxpayers foot the bill of a sadistic masochistic gaurd with little or no regards to human beings outside of his kin, kind and ilk…probably a wifebeater also..they always are. Big body, small brain even smaller dxxk.
These dimwitted officers need to be relocated out of the justice system. So the take on it is if no policy for this then no actions can be taken, so with that train of thought if a pitch fork was used would the same ridicules outcome happen. There are many very competent police officers, jail staff looking out for the publics better interest but lets call this out for what it is, officers that do not need to be in these such positions. ( common sense)

He shouldve never been placed in a prison in the first place, rather than a mental institution, but democrat policies refuse to invest money into that. Instead, we send money to a country (Ukraine) that didnt even give a damn about us in the first place. What choice did they have if he was not complying? These CO’s are not doctors or psychologists, and to just assume they know his mental stability at the time is irresponsible. If an inmate does not comply with lawful orders, measures will and should be taken to assure proper procedures are met. Its not the inmates’ home to dictate what they choose to do. Blame the system, and not the officers.
I work in retail and work with cleaning supplies. If I use the wrong supplies or use it incorrectly I could get in major trouble. You’re going to tell me no policy was broken, yet they used the WEAPON incorrectly and went against safety protocols set by the manufacturer ??? Seems like it’s okay to harm others as long as you work against the government.
No policy violated because there was no policy in place on how to use this weapon? Pretty clever defense. How about the policy that the majority of law enforcement agencies have in place regarding not using any weapon that the department/law enforcement agency has not been properly trained in using? I know a family member that was a corrections officer for over 30 years at a maximum security prison. Some “discipline” was handled off the books, but no one EVER used a weapon on an inmate. As my family member put it, they were outnumbered 12 to one, and so sometimes things had to get physical to reinforce the power balance. But, this same family member was pretty well respected among inmates as being fair to everyone. He even fired an officer on the spot after he received a tip from an inmate that the officer was going around after lights out, and spraying pepper spray into the cells while the inmates were trying to sleep. He followed the officer the next night and saw him do it, and fired him on the spot. What goes on in prisons is not for the fait of heart, but this dick needs to be charged and prosecuted. If the guy up north got murder charges for kneeling on someone’s shoulder, then this guy definitely needs to go to jail for discharging a firearm.

It appears the officer directed the shotgun directly at the victim through the door . Could a dart not have been used or tazer. What is a concern is the increasing number of crimes commited by people having or claiming to have mental issues.When i was young such violence simply did not exist and i saw men in wheel chairs with one or no legs from WW1 (i am 73) There were of course mental Hospitals with lock up wards and treatment using electrodes which is considered inhumane now . I have never suffered from depression so can not speak on how it may feel. I do wonder though if there is a genuine increase in mental issues as to why? Could it be the modern pressures of life,perhaps some new inventions or perhaps the use of drugs not done when i was young.Truly a different world when i was young SOMETHING has changed for absolute sure to change the behaviour of humans.
Situations like this call for a officer or mediator that had some type of training in dealing with someone with a mental illness.Cop or not that should be excessive use of force or something.It’s messed up that even with a camera rolling he can get away with doing this to someone,but let that same individual punch him in the face.He would have every charge in the book thrown at him.Individuals shouldn’t be able to hide behind laws that allow them to harm others when unnecessary.
What you mean he wasn’t an immediate threat? Can’t you see he’s only in the middle of a prison, locked in a room made of nearly impenetrable cement and behind a steel door. Those officers didn’t have any other choice, other than to walk away, and officers never walk away – even if you’re locked up in prison.
First of all, I don’t see a reason to use the shotgun as he is already in the jail and unarmed. Secondly, it was way to damn close even for a typical police bean bag round! Thirdly, If it was necessary for the officers to go “hands on” (and let’s assume that it was in order to take him somewhere) why not simply taser him through the opening? If tasers are not allowed in this jail then why the hell not? The Sheriff’s Department allows for the usage of these rounds on people when the manufacturer plainly and clearly states “not to be used on humans”???? Seriously? By allowing this they are by default setting themselves up for a civil suit and there is no shortage of lawyers that are at the ready and waiting. This is a scenario that an attorney lusts for and is a true gift to him! Jails are a necessary evil and thus must be manned by officials but stupid policy is avoidable. Somebody needs to go through the entire department with a “stupid detector” and see where things can be changed and quickly so!
I was literally in the cell RIGHT NEXT to him when this happened. It sounded like a grenade went off. No one on J-Wing could hear for a week. The dude was just screaming and screaming. It was awful because it was obvious to every single one of us this was a sick man going through a psychotic break and we were witnessing someone being physically tortured for being sick. All while knowing if we got too wild, this too could happen to us.
Working in DoC and DPHHS, prisons and mental health hospitals, this abuse is such a widespread problem and administration doesn’t give care one bit. I’ve turned in 6! Different people for different types of abuse. And each time and each facility I’ve turned someone in at, Ive been targeted by administration and watched like a hawk for ANY little tiny thing I can get in trouble for. The abuse is something like staff straight up refusing to give a patient or inmate hygiene items because they did something staff doesn’t like. Or the times where prison guards are literally fabricating assault stories to add time on inmates as they near the end of their sentence just because someone doesn’t like them. Or when a patient at the hospital is having a mental breakdown and then is strapped to a bed against their will just because they’re confused. Sometimes this has to happen for their own safety but more often than not it’s used as a punishment which is completely unacceptable in any mental health setting.
As an army veteran I know how afraid law enforcement officers get when they find out what you are, they don’t have any training or skills,and know that you can take them easily and even though you are a veteran of the United states military they tend to become more aggressive rather than calmer even though no crime has been committed a week later they want to thank you for your service
I dont care whether this inmate is crazy or a muderer or worse.theres no reason for those guards to shoot through that door opening.the shooter needs to be charged with atempted murder and the other guards charged with conspiracy to commit murder.that inmate was right up against that door when they shot him.and for them to then try to lie n cover up the facts.wow talk about corruption
Having a brother with schizophrenia for almost 50 years my heart goes out for the inmate. I don’t understand where the threat is. All they had to do is wait a little while for him to calm down and everything would have been fine. My brother lives in an excellent group home where the trained and experienced staff deals with this periodically. These officers need more training period. How did the litigation pan out?

Wow,thank for showing me that I ain’t missing it there and being diagnosed in my late 20s I’m lucky they didn’t have that kind of toy yet. Being treated with something alot more better with a program that offered a bit more then jail hospital when I was not able to understand what was going on in my mind in those extreme symptoms of schizophrenia, 20 years later, well in the lyrics of a song I purchased for under a buck by an artist I would later in life learned to be Joe Walsh, I can’t complain but sometimes I still do life’s been good to me so far!

If you are wondering the lawsuit against the county was settled two years later for an undisclosed amount of money. The county spent about $30,000 of taxpayers dollars trying to keep the article from being released. They investigated themselves and found nothing wrong with shooting the unarmed man in the cell.
This is why we hate cops that’s why we hate probation officers and prison guards… I love it every time one of them gets killed prison guards they just do the killing there’s no way to kill one of them cuz there’s 40 to one like there’s seven or eight 250 or 350 lb grown men who are absolute Killers standing outside that guy’s cell door he’s 175 pounds naked.. and they all sat back and relished as they shot that man they love to hear him scream. Too cowardly for words, this veteran may have been affected by his service to his country and they choose to treat him like a rabid dog, shameful. In my country they enter a cell as a group with helmets shields protective equipment and body armour no weapons needed they control the subject and subdue him. Usually without serious harm to anyone involved.

I work for a jail for 4 years and you are not allowed to go in unless he was being a danger to himself. As you can see in the article he is in an ISO cell (isolated do to aggressive or intoxicated behavior) he also had a GREEN suit on witch is a type of uniform that requires the inmate to be totally naked. He is not allowed to have anything else in that cell . All the COs know that they can’t go in on less during a CEll check that is done every 15 to 30 min. If the inmate is not moving or breathing then they can open the door and try to get a response from him.

$millions of dollars that is what I would have sought. Losing money would motivate them to make the SOP for that level of force and how to employ it humanely. It will also pressure them to look long and hard at those correctional officers to see that they don’t do that again… it would be too costly
Using the gun, even with a nova round, was excessive. Now forcing entry into his cell, on the other hand, is quite legitimate. They would have been within their rights to use pepper spray, tasers, or even just brute force to subdue and remove him from the cell in this circumstance. I have seen jails use pepperball guns and beanbag rounds before, but those are designed for these sorts of situations. As to the comment about him being violent: Just because he has no convictions for violent crimes does not mean he is not violent. He may be violent with corrections staff, other inmates, etc. and may offer significant resistance when they attempt to detain him or otherwise deal with him. That does not always result in criminal charges, but may be handled by institutional discipline instead (solitary confinement, etc) if it’s not particularly bad. For example, if two inmates have a fistfight, they don’t always end up getting an assault charge. Usually they just get broken up and sent to adseg, lose privileges, good time, etc. If they’re seriously injured or manage to injure a staff member, then yeah, they’ll probably catch an actual charge. So you can’t say there is no violence if all his violent episodes are on his jail record rather than his criminal record, especially since his mental health itself may be seen by prosecutors as a reason not to pursue charges.
The shooting scene was cut just as it was about to happen – guy hands over money for gas and gets shot due situation has grown tense – I think those 2 brothers did disrespect the guy, they saw him as no threat (lesson!) and even taunted him but geez to kill someone cause you been dissed and then sit in jail for the best years of your life – a lesson for all of us to just swallow our pride, it’s just not worth it to show others that we are the MAN, just not worth it. I hope I can walk away when in similar situations and remember the prideful will fall.

This was first time these men met and it went roughly like this: Ernest Phillips, shooter, in red dress at counter facetime with girlfriend while waiting for sandwich. Francisco Ashley in brown dress walked up playfully to Ernest and photobombed to Ernest’s girlfriend. Ernest felt insulted. Roger Ashley wearing black durag, victim, brother of Francisco, can be seen at beginning of article standing at bottom right. Argument ensured. 1:47 Roger lunged at Phillips, leading Phillips to cower toward the counter. Roger while holding a $20 bill went out to check his pump number then came back to clerk. Ernest killed Rogers.
