Or even if a permit was obtained, such as this particular deck. Railings and guardrails have been in the code for decades. And as you know the the code changes every 3 years. Baluster spacing used to be 6 in. And went to 4 in. As I recall in the mid 80s, if memory serves. Along with changes in height etc. if this deck was constructed with out permit all bets are off, then the buyer has leverage.
